This page, the Latest Scoop on IDEA Regs!, was designed to pick up the story of IDEA reauthorization at the point in time we were all waiting for final regulations to be published on the 2004 statute. Now that we HAVE final regulations (as of August 14, 2006), this page is no longer necessary as a way to keep you informed about progress toward that destination. The story, thus, ends with the information presented below, which connects you to the law's final implementing regulations and the model forms that OSEP was required to publish at the same time.

August 14, 2006

An official copy of the final Part B regulations of the IDEA were published in the Federal Register on August 14, 2006.

The Model Forms.
OSEP (the Office of Special Education Programs) published the model forms that were required to be made available at the time IDEA's regulations were made final. This includes model forms on the IEP, the procedural safeguards notice, and prior written notice. Find the model forms at:

August 3, 2006

The Department of Education announced the final Part B regulations to implement the Individuals with Disabilities Education Improvement Act of 2004 (IDEA). An official copy of the final Part B regulations of the IDEA will be published in the Federal Register on August 14, 2006. So that members of the public will have the opportunity to immediately review the new Part B regulations of IDEA, the Department has temporarily posted an UNOFFICIAL copy at:

The official version of the IDEA 2004 proposed regs, as published in the Federal Register, are available here.

Public hearings have been held around the country to give individuals an opportunity to make comments and provide input on the proposed regulations.

The public is further invited to submit written comments for review prior to the development of final regulations. To be considered, all written comments must be received by 5 p.m. on September 6th, 2005.

Hot off the press! The draft regulations for the reauthorized IDEA are now available. Here's the announcement verbatim from Troy Justesen, Office of Special Education and Rehabilitative Services (OSERS), dated Friday - June 10, 2005.

I'm pleased to inform you that the Office of Management and Budget (OMB) and Secretary Spellings have signed the proposed regulations to implement the Individuals with Disabilities Education Improvement Act of 2004 (IDEA). This follows a concerted effort by many in OSERS to review the old and new law, receive public comments, and draft the proposed regulations. Many thanks to all who contributed to this effort.

So that members of the public will have as much time as possible to review the proposed regulations, the Department has posted an unofficial copy on its Web site at www.ed.gov/policy/speced/guid/idea/idea2004.html Using that link, members of the public can also view the dates and locations for a series of public meetings where comments on the proposed regulations will be received by OSERS. Information on submitting written comments on the proposed regulations can also be found using that link.

Having feedback on the draft regulations from parents, teachers, students, state officials and other interested persons is critical for us. We want the final regulations to reflect the dialogue we've been having with the public since the President signed the law last December.

An official email to our stakeholders will be coming out later today. Please feel free to let your customers know about the availability of the unofficial regulations on ed.gov at the site referenced above.

The first bit of news is that public meetings are already being scheduled to receive public comment on the anticipated draft regulations, called the NPRM (Notice of Proposed Rule Making). The list below of scheduled meetings comes from John H. Hager, assistant secretary of OSERS (Office of Special Education and Rehabilitative Services).
